1. Definitions
In these Terms and Conditions, the following terms carry the meanings set out below:
- "Service" refers to the senior residence arrangements offered by Hồ Sen, including Weekend Retreat Stays, Lakeside Residence, and Heritage Suite with Personal Concierge, as well as this website.
- "User" refers to any individual accessing this website or enquiring about Hồ Sen's services.
- "We / Us / Our" refers to Hồ Sen, located at 22 Quảng Bá, Tây Hồ District, Hanoi 100000, Vietnam.
- "Resident" refers to a senior individual residing at Hồ Sen under a current residence arrangement.
- "Family Representative" refers to an authorised adult (typically a family member) acting on behalf of or in coordination with a Resident.
- "Agreement" refers to these Terms and Conditions, together with any specific residence arrangement documentation.
2. Acceptance of Terms
By accessing this website or enquiring about our services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you are acting on behalf of another person, you represent that you are authorised to do so. Use of this website constitutes acceptance of these Terms.
3. Service Description
Hồ Sen provides non-medical senior residential services in Tây Hồ District, Hanoi, Vietnam. Our services include shared and private accommodation, prepared meals, social and cultural activities, and personal concierge services (Heritage Suite only). We are not a medical facility and do not provide clinical, nursing, or therapeutic services of any kind.
Services are available to residents within Vietnam. Enquiries from internationally based family representatives are welcomed.
4. Residence Arrangements
All residence arrangements are confirmed following a personal conversation with our team and completion of our admissions process. Specific terms — including duration, included services, and pricing — will be set out in a written arrangement document provided to the Resident or Family Representative before commencement. These Terms apply in addition to any arrangement-specific documentation.
- Weekend Retreat Stay: Available on a per-weekend or recurring booking basis. Bookings may be cancelled with a minimum of 48 hours' notice.
- Lakeside Residence (Monthly): Requires a minimum notice period of 30 days prior to conclusion of the arrangement.
- Heritage Suite with Concierge (Monthly): Requires a minimum notice period of 30 days prior to conclusion of the arrangement.
5. User Responsibilities
Users of this website agree to use it only for lawful purposes and in a manner that does not infringe the rights of others. Prohibited activities include, but are not limited to:
- Submitting false or misleading enquiries
- Attempting to access systems or data beyond normal website use
- Reproducing or distributing content from this website without our written permission
Family Representatives entering a residence arrangement on behalf of a Resident represent that they are authorised to do so and that the information provided is accurate to the best of their knowledge.
6. Intellectual Property
All content on this website — including text, design, images, and layout — is the property of Hồ Sen or its licensors. Users are granted a limited, non-exclusive licence to view and access content for personal, non-commercial use. Reproduction, modification, or commercial use of any content without our written consent is not permitted.
7. Payment Terms
Pricing for each residence plan is quoted in Vietnamese Đồng (₫) and is current as of the date of enquiry. Payment terms will be specified in the written arrangement document. We reserve the right to update pricing with reasonable notice. Refunds for prepaid periods, in cases of early termination, are at our discretion and will be handled on a case-by-case basis with fairness.
8. Service Delivery Terms
We commit to providing the services described for each residence plan with reasonable care and in the spirit of our stated approach. We may, on occasion, need to modify the activity schedule or specific offerings due to circumstances outside our control (such as public holidays or supply disruptions) and will communicate these changes promptly. We do not guarantee specific outcomes from residence, including improvements to health or wellbeing.
9. Disclaimers
Our services are provided in good faith and with care, but on an "as is" basis without warranties of any particular kind beyond those implied by Vietnamese consumer law. We do not provide medical or clinical guarantees of any nature. Information on this website is for general informational purposes only.
10. Limitation of Liability
To the extent permitted by Vietnamese law, our total liability for claims arising from or related to our services will not exceed the total fees paid by the Family Representative or Resident for the relevant period. We are not liable for indirect, consequential, or incidental losses. This limitation does not apply to liability arising from gross negligence or wilful misconduct.
11. Indemnification
You agree to indemnify Hồ Sen against claims, losses, or costs arising from your misuse of this website or breach of these Terms.
12. Termination
Either party may end a residence arrangement in accordance with the notice periods specified above. We reserve the right to terminate a residence arrangement with shorter notice in exceptional circumstances, including conduct that is unsafe or harmful to other residents or staff. In such cases, we will act fairly and communicate clearly.
13. Dispute Resolution
These Terms are governed by the laws of the Socialist Republic of Vietnam. In the event of a dispute, the parties will first attempt to resolve the matter through informal discussion. If a resolution cannot be reached, disputes will be referred to the competent courts in Hanoi, Vietnam.
14. General Provisions
These Terms, together with any written residence arrangement, constitute the entire agreement between us. If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect. Our failure to enforce any provision does not constitute a waiver of that right.
15. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of our website or ongoing residence following notification of changes constitutes acceptance of the updated Terms.
